These Terms & Conditions ("Terms") are an agreement between you and CustomWorks Studio, Inc., a business doing business as Oscar Headshots and Oscar Photo (together, "CustomWorks Studio", "we", "us" or "our"). Oscar Headshots and Oscar Photo are registered trade names (DBAs) of CustomWorks Studio, Inc. and are not separate companies. These Terms apply to your use of oscarheadshots.com (the "Site"), to the photography services we provide, and to our text message (SMS) program. By using the Site, submitting a form, booking a session or opting in to text messages, you agree to these Terms and to our Privacy Policy.

1. Our Services

CustomWorks Studio, Inc. provides professional photography services, including business and corporate headshots, actor and talent headshots, team and staff photography, and personal branding photography. Package contents, pricing and what is included in each session are described on the Site and on your quote, invoice or booking confirmation. If anything on the Site differs from your invoice or booking confirmation, your invoice or booking confirmation applies.

2. Bookings, Payment and Rescheduling

A session is reserved once payment (or any deposit stated on your invoice) has been received through our secure online payment page. Payments are processed by Stripe; we do not see or store your full card number. Prices are in U.S. dollars. Booking deposits: if you cancel more than 48 hours before your scheduled session time, your booking deposit will be refunded. Booking deposits are non-refundable if you cancel within 48 hours of your session time, or if you do not attend your session. Any other cancellation, rescheduling or refund terms stated on your invoice or booking confirmation also apply. If you need to reschedule, please contact us as early as possible at the email address or phone number below. If we must reschedule a session (for example because of illness or an emergency), we will offer you a new date or a refund of the amounts you paid for the session.

3. Your Responsibilities

You agree to provide accurate contact and booking information, to arrive on time for your session, and to use the Site only for lawful purposes. You agree not to submit false information, spam, or harmful content through our forms, and not to attempt to interfere with the Site's operation or security. If you book on behalf of a company or another person, you confirm that you are authorized to do so.

4. Photographs, Copyright and Usage

CustomWorks Studio, Inc. owns the copyright in all photographs it creates, unless we agree otherwise in writing. When your session is paid in full, you receive a license to use your final delivered images for the purposes included in your package (for example personal, professional, editorial or business profile use), as described on the Site and on your invoice. Additional licenses (such as print or extended commercial licenses) are available as listed. You may not resell the images or claim them as your own work. We may use images from your session in our portfolio, on the Site or on social media unless you ask us in writing not to; we will honor that request.

5. SMS / Text Message Program

Program: CustomWorks Studio, Inc. (dba Oscar Headshots) booking and session messages.

How you opt in: by selecting the SMS consent option on our contact form, or by asking us directly to text you. Consent is optional. You do not have to agree to receive text messages as a condition of purchasing or booking any service.

What we send: messages about your inquiry, quotes, booking confirmations, session reminders, scheduling changes, and image delivery or selection. We do not send marketing text messages unless you separately agree to receive them.

Message frequency: varies depending on your inquiry and booking; typically no more than a few messages per booking.

Cost: Message and data rates may apply, according to your mobile plan.

Opting out: Reply STOP to any message to stop receiving texts from us. You will receive one final message confirming that you have been unsubscribed. You can also ask us to stop by email or phone.

Carriers: Mobile carriers are not liable for delayed or undelivered messages.

Eligibility: You must be at least 18 years old, or have permission from a parent or guardian, and be the account holder or authorized user of the mobile number you provide.

Privacy: We do not sell, rent or share your mobile number or SMS opt-in consent with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy for details.

6. Website Content

All text, photographs, graphics and other content on the Site are owned by or licensed to CustomWorks Studio, Inc. and are protected by copyright and other laws. You may view the Site for your personal use, but you may not copy, reproduce, distribute or use its content without our written permission. The Site may link to other websites; we are not responsible for their content or practices.

7. Disclaimers

The Site and its content are provided "as is" and "as available". We work to keep information on the Site accurate, but we do not guarantee that it is complete, current or error-free, or that the Site will always be available. Photography is a creative service: results depend on many factors, and we do not guarantee any particular outcome, such as casting decisions or job offers, from the use of your photographs.

8. Limitation of Liability

To the fullest extent permitted by law, CustomWorks Studio, Inc. will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our services. Our total liability for any claim relating to a session or service will not exceed the amount you paid for that session or service.

9. Indemnification

You agree to indemnify and hold harmless CustomWorks Studio, Inc. and its officers and employees from any claims arising from your misuse of the Site, your violation of these Terms, or your use of the photographs outside the license granted to you.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Miami-Dade County, Florida.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above shows when they were last changed. Changes apply from the date they are posted on this page.
